To ensure wide dissemination of its information, SEAFDEC/TD is committed to making its content freely available and encourages the use, reproduction, and dissemination of the text, multimedia, and data presented. The SEAFDEC/TD logo is the corporate identifier and official seal of the organization, and it is protected under international treaties and conventions on intellectual property. Its use is highly restricted and is prohibited without prior permission.   1. Discussion Fora and Commenting Tools

The SEAFDEC/TD website contains specialized discussion forums and commenting tools. When participating, users agree not to:

  • defame, abuse, harass, threaten, or otherwise violate the rights of others;
  • publish, post, distribute, or disseminate defamatory, infringing, obscene, indecent or unlawful material;
  • upload or attach files that contain software or other material protected by intellectual property laws unless the user owns or controls the rights and has received all necessary permissions;
  • upload, email, transmit, or otherwise make available unsolicited advertising of any goods or services, or conduct or forward surveys, contests, "spam" or chain letters, etc.

Users specifically acknowledge that SEAFDEC/TD is not liable for the conduct of any other user. Users repeatedly posting material that falls into the above categories will be removed and/or banned from participating in the related fora and commenting tools.

  1. Security

For site security purposes and to ensure that this service remains available to all users, SEAFDEC/TD employs software programs to monitor network traffic and identify unauthorized attempts to upload or change information or otherwise cause damage.

Except for authorized investigations and to maintain required correspondence files, no other attempts are made to identify individual users or their usage habits. Raw data logs are used to determine the number of users and, occasionally, which general domains are accessing the SEAFDEC/TD website. SEAFDEC/TD also collects anonymous information about users’ browsing behavior when users visit the website through the use of cookies. By using the SEAFDEC/TD website, users agree that SEAFDEC/TD can place cookies on users’ computers, mobile phones, or handheld devices.  

Any information provided to SEAFDEC/TD by users is held with the utmost care and security and is not used in any manner other than that set forth in the Privacy Policy for using of SEAFDEC/TD Apps or in any additional site-specific policies without users' explicit consent.

All SEAFDEC/TD employees who have access to or are associated with the processing of personal data are obliged to respect the confidentiality of official business matters, including personal data.

Use of SEAFDEC/TD Applications

By downloading and using the SEAFDEC/TD Application, you acknowledge and agree that these Terms and Conditions shall apply, including in connection with the processing of any personal or third-party data you may make available through the SEAFDEC/TD Application.

  1. Definitions

The following definitions shall apply to these Terms and Conditions.

Authorized vendor and/or subcontractor:

a company, organization, institute or other legal entity which may supply goods, works or services to SEAFDEC/TD in relation to any SEAFDEC/TD Applications, and authorized by SEAFDEC/TD to access to and/or process data in accordance with these Terms of Conditions.

Contact Data:

means data provided by you when contacting SEAFDEC/TD by any means, including by sending an email or filling a form. The Contact Data comprise: (a) your name and/or surname, (b) your email address; (c) your postal address; (d) your telephone number; (e) the organization or company you are representing or working for, if applicable; (f) any other content or information conveyed by means of your communication to SEAFDEC/TD. The Contact Data may include Personal Data.

Database Data:

Data other than contact, personal or registration data provided by you by using the SEAFDEC/TD application. This includes data submitted by you using forms and/or by performing certain actions within a SEAFDEC/TD application. This data is public and could be made available to other users.

Personal Data:

means any information relating to a person who is or can be identified either from the data, or from the data in conjunction with other information that is in, or is likely to come into, the possession of SEAFDEC/TD and/or its authorized vendors or subcontractors. Personal Data may include but is not limited to, an individual’s[1] (a) name and/or surname, (b) place/date of birth, (c) age, (d) gender, (e) nationality, (f) country, state, postcode, city or village of residence, (g) job title, (h) personal contacts (e.g. postal address, email address, telephone number, etc.).

Processing of Personal Data:

means any operation or set of operations which is performed on or using personal data, whether or not by automatic means, such as collection, recording, organization, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, blocking, erasure or destruction.

Registration Data:

means data provided by you when creating a Personal Account in a reserved area section of the SEAFDEC/TD website, for the purpose of downloading a SEAFDEC/TD Application. The Registration Data comprise: (a) your name and/or surname, (b) your email address; (c) the organization or company you are representing or working for, if applicable, and (d) any other information that may be required by SEAFDEC/TD for purposes of registration. Registration Data may include Personal Data.

SEAFDEC/TD Database:

A database managed by SEAFDEC/TD or an authorized vendor or subcontractor to store and process Database Data.

SEAFDEC/TD Applications:

A web-based and mobile applications (Apps) are software specially designed to run on both web-based and mobile devices such as smartphones and tablets.

Third Party(ies):

means any natural or legal person, public authority, agency or any other body other than the user, SEAFDEC/TD and/or SEAFDEC/TD’s authorized vendors and subcontractors, who may access and process data from a SEAFDEC/TD database.

  1. Processing of Personal Data

When you download a SEAFDEC/TD Application (as described in paragraph 2.1 below), when you use a SEAFDEC/TD Application (paragraph 2.2 below), and when you contact SEAFDEC/TD (paragraph 2.3 below), you may entrust SEAFDEC/TD with your information, including your Registration Data, Personal Data and Contact Data.

You are not required to provide any information to SEAFDEC/TD or to download or use a SEAFDEC/TD Application. However, in some cases, failure to provide certain information may prevent you from downloading or accessing a SEAFDEC/TD Application, and/or may affect the availability or correct functioning of a particular feature or service associated with a SEAFDEC/TD Application.

Personal data will only be used for the purpose(s) specified in these Terms and Conditions. Should SEAFDEC/TD use or process your Data for any other purposes, SEAFDEC/TD will inform you and request your consent.

When you choose to provide SEAFDEC/TD with your information, including Registration and Personal Data, the following conditions shall apply to its processing:

2.1    Downloading a SEAFDEC/TD Application

In order to download a SEAFDEC/TD Application, you are required to create a Personal Account in the relevant reserved area section of the SEAFDEC/TD website (hereinafter "Reserved Area").

The conditions described in this sub-section 2.1 apply to the provision and processing of data relating to the download of a SEAFDEC/TD Application from the SEAFDEC/TD website. Should the SEAFDEC/TD Application be downloaded from a website or server administered by other legal entities (e.g. Google Play, Apple Store), the provision and processing of Registration Data and/or Personal Data may also be subject to the terms, conditions and policies of such legal entities, as applicable. SEAFDEC/TD is not responsible for the treatment by other entities of information you provide, including any Registration Data.

2.1.1   Personal Data Involved

When creating a Personal Account, you will be required to provide your Registration Data.

2.1.2   Use of Registration Data 

Consent to SEAFDEC/TD’s processing of the Registration Data is necessary if you wish to download a SEAFDEC/TD Application. You are not required to provide any information to SEAFDEC/TD, including Registration Data; however, if you do not consent to the above, you will be unable to register your Personal Account and download the SEAFDEC/TD Application.

2.1.3   Applicable rules

Your Registration Data will be processed by SEAFDEC/TD in accordance with SEAFDEC/TD’s rules, policies, and practices, to the exclusion of any single national system of law. In addition, your Registration Data may be processed by SEAFDEC/TD’s authorized vendors or subcontractors and, therefore, subject to additional rules, policies, and procedures that they may have in place. For more information about these, please contact the SEAFDEC/TD IT Officer.

The Registration Data will be processed by SEAFDEC/TD and/or its authorized vendors or subcontractors for purposes of enabling you to download the SEAFDEC/TD Application and to manage your account. SEAFDEC/TD and/or its authorized vendors or subcontractors may also use Registration Data, as well as authentication and tracking logs, for technical administration purposes, including producing usage statistics and troubleshooting.

SEAFDEC/TD will not share, sell, distribute or rent Registration Data to any Third Party without prior authorization of the person to which such Data refer.

2.2    Use of a SEAFDEC/TD Application

When you download a SEAFDEC/TD Application, the SEAFDEC/TD Application will be saved on your mobile device. The use of the SEAFDEC/TD Application may sometimes require the processing of Personal Data. Such Data will be saved locally on your device. Under such circumstances, SEAFDEC/TD shall have no access to the information, including Personal Data, that you have provided and stored on your mobile device, and SEAFDEC/TD shall not be responsible for any loss or damage arising from the use of the SEAFDEC/TD Application or the processing of information, including Personal Data, included or generated therein.

2.2.1   Personal Data Involved

Information provided when using a SEAFDEC/TD Application may include Personal Data.

2.2.2   Use of Personal Data

You may wish to share information, including Personal Data, with SEAFDEC/TD through a SEAFDEC/TD Application, [e.g. by sending it by email or text message, or by uploading it on a SEAFDEC/TD database]. If you choose to do so, all such information, including Personal Data will be processed by SEAFDEC/TD and its authorized vendors and/or subcontractors through a SEAFDEC/TD Database. Information, other than Personal Data, provided when using a SEAFDEC/TD Application and any information generated through it will be processed by SEAFDEC/TD and/or its authorized vendors or subcontractors and may be made available to Third Parties exclusively in an aggregate and anonymized manner and for statistical and monitoring purposes only.

2.2.3   Applicable rules

All information, including Personal Data, shared with SEAFDEC/TD through a SEAFDEC/TD Application will be processed by SEAFDEC/TD and/or its authorized vendors or subcontractors in accordance with SEAFDEC/TD’s rules, policies, and practice to the exclusion of any single national system of law. Personal Data will be treated by SEAFDEC/TD and its authorized vendors and/or subcontractors as confidential in accordance with SEAFDEC/TD’s rules, policies, and practice and will not be disclosed, sold, distributed, or rented to Third Parties without prior authorization of the person to which such Data refer.

2.3    Contacting SEAFDEC/TD

When downloading or using a SEAFDEC/TD Application, you may wish to contact SEAFDEC/TD in connection with the Application.

In such cases, when you contact SEAFDEC/TD by any means, including by sending an email or completing a form, you provide SEAFDEC/TD with Contact Data.

You acknowledge and agree that by contacting SEAFDEC/TD, you are consenting to SEAFDEC/TD’s processing of the Contact Data. Failure to provide some Contact Data may hinder SEAFDEC/TD’s ability to communicate with you and/or to fully or properly provide feedback to your communications to SEAFDEC/TD.

2.3.1   Personal Data Involved

When you contact SEAFDEC/TD, you provide SEAFDEC/TD with your contact information.

2.3.2   Use of Contact Data

The Contact Data will be processed by SEAFDEC/TD and/or its authorized vendors or subcontractors for purposes of providing feedback to your communication and addressing any request contained therein. SEAFDEC/TD and/or its authorized vendors or subcontractors may also use Contact Data for technical administration purposes, including to produce usage statistics and troubleshooting.

2.3.3   Applicable Rules

All information, including Contact Data, will be processed by SEAFDEC/TD in accordance with SEAFDEC/TD’s rules, policies, and practices, to the exclusion of any single national system of law. For more information, please contact the IT Officer.

2.4    Use of a SEAFDEC/TD Database

Database Data provided when using or generated through SEAFDEC/TD Applications will be processed by SEAFDEC/TD and/or its authorized vendors or subcontractors and may be made available to Third Parties.

2.4.1   Data Involved

Database Data, i.e., data other than contact, personal, or registration data provided by you by using the SEAFDEC/TD application. This includes data submitted by you using forms and/or by performing certain actions

2.4.2   Use of Information

The Database Data will be processed by SEAFDEC/TD and/or its authorized vendors or subcontractors for purposes of presenting and/or aggregating information to do further analysis. This information will be freely available via the SEAFDEC/TD website or the SEAFDEC/TD application as appropriate.

2.4.3   Applicable Rules

All information processed through SEAFDEC/TD Databases will be processed by SEAFDEC/TD in accordance with SEAFDEC/TD’s rules, policies, and practices, to the exclusion of any single national system of law.   1. Responsibility of User

As a user, you acknowledge and agree that you are responsible for ensuring the integrity and security of the information that you provide when accessing or using a SEAFDEC/TD Application, including any Personal Data, irrespective of whether this Personal Data belongs to you or to a Third Party.

In the event that you are not the owner of the Personal Data you process using the SEAFDEC/TD Application, you further acknowledge and agree that you are responsible for obtaining the prior informed consent of the owner of the Personal Data you collect as regards the use and processing of his/her Personal Data by SEAFDEC/TD and/or its authorized vendors and subcontractors as described in these Terms and Conditions for the of Use of a SEAFDEC/TD Application.

  1. Responsibility of SEAFDEC/TD

SEAFDEC/TD shall process Registration Data, Personal Data, Contact Data, and Database Data in accordance with its rules, policies, and practice, to the exclusion of any single national system of law. SEAFDEC/TD’s authorized vendors and subcontractors may also treat such Data in accordance with any additional rules, policies, and practices that may apply to their operations.

To prevent unauthorized access, maintain data accuracy, and ensure the correct use of information, SEAFDEC/TD has put in place appropriate physical, electronic, and managerial procedures to safeguard and secure the information we process, consistent with the SEAFDEC/TD’s rules, policies, and practice.

SEAFDEC/TD shall not be liable for any loss or damage arising from, or directly or indirectly connected to, the use or operation of any of its Applications or Databases, including, but not limited to, any liability arising from any intentional or negligent misuse, errors, disclosure, undue transfer, loss or destruction of data that may occur.

SEAFDEC/TD does not represent or endorse the accuracy or reliability of any data, information, or other material provided by any user through SEAFDEC/TD Applications or accessible through SEAFDEC/TD Databases. SEAFDEC/TD explicitly disclaims any responsibility for the content of such data, information, and materials provided or processed through SEAFDEC/TD Applications and/or SEAFDEC/TD Databases.

SEAFDEC/TD reserves the right at any time, and from time to time to modify or discontinue, temporarily or permanently, the SEAFDEC/TD Applications and/or Databases, including any means of accessing or utilizing them, at its sole discretion with or without prior notice to you.

SEAFDEC/TD may, at its sole discretion, under any circumstances, for any or no reason whatsoever and with or without prior notice to you, terminate your access to any of its SEAFDEC/TD Databases, including to any means of accessing or utilizing them.

Changes to these Terms and Conditions will be posted on this webpage and will be available via the SEAFDEC/TD website. By continuing to use a SEAFDEC/TD Application subsequent to SEAFDEC/TD making amendments to these Terms and Conditions available, you acknowledge, agree, and consent to such amendment(s).

  1. Profile Deletion and Data Retention

Data processed under these Terms and Conditions may be kept by SEAFDEC/TD and its authorized vendors and/or subcontractors for as long as is necessary for purposes of ensuring the proper use and functioning of the relevant SEAFDEC/TD Application and Database.

At any time, you can delete, review, correct or update your Contact, Registration and Personal Data by accessing your Personal Account. Residual data may remain within SEAFDEC/TD Databases and other SEAFDEC/TD records, which may or may not contain Personal Data you have provided.
